This legal notice regulates the use of the Internet portal service www.camerdata.es.com.org.net (the "Portal") made available to Internet users by CAMERDATA S.A. ("CAMERDATA"), with registered office at Avenida Diagonal 452, Barcelona, Spain.
Persons using the Portal acquire the status of user (the "User") and as such fully and unreservedly accept all the provisions included in this Legal Notice in the version published by CAMERDATA at the time the User is provided with access to the Portal. Consequently, the User must read this Legal Notice carefully each time he intends to log into the Portal, as the contents hereof may be subject to amendment.
The use of certain services offered to Users through the Portal may also be subject to general terms and conditions specific to each service (the"General Terms & Conditions") which in some cases may substitute, complement and/or amend this Legal Notice. Therefore, prior to using the above services, the User must also pay careful attention to any General Terms & Conditions which apply.
Use of the Portal is equally subject to all notices, regulations for use and any instructions brought to the attention of the User by CAMERDATA which substitute, complete and/or amend this Legal Notice.
This Legal Notice regulates the Portal facilities made available by CAMERDATA and the use of the Portal by Users.
Through the Portal, CAMERDATA provides Users with access to and use of the various services and contents (the "Services") made available by CAMERDATA or by third parties.
CAMERDATA reserves the unilateral right to amend, at any time and without prior notice, the presentation and configuration of the Portal and likewise the Services and the terms and conditions required for use of the Portal and the Services.
Certain Services supplied by CAMERDATA are free of charge and do not require the User to subscribe or register in advance. However, the use of some Services supplied by CAMERDATA or by third parties through the Portal requires the User to subscribe or register in advance and/or is subject to payment of a fee.
The provision of Services does not generally require Users to subscribe or register in advance. However, for the use of certain Services, CAMERDATA does require the User to fill in a form and send it in advance. The form for those who wish to register is available on www.camerdata.es/php/eng/registro_clientes_eng.php. CAMERDATA likewise makes available to Users certain services for which the registration procedure is expressly stated in the Service itself or in the General Terms & Conditions by which the Service is regulated.
All information provided by the User through the Services must be truthful. To this end, the User warrants the authenticity of all particulars provided when completing the forms required for subscription to the Services.
Likewise, the User is responsible for keeping all information provided to CAMERDATA permanently up to date so that the information reflects at all times the User's real situation. The User shall be the sole party responsible for any misrepresentation or inaccuracy in his statements and for any damages which may be caused to CAMERDATA or to third parties by the information which the User provides.
The User agrees to use the Portal and the Services in conformity with the law, with this Legal Notice, with the General Terms & Conditions for certain Services, with all other notices, regulations for use or instructions made known to him and in keeping with moral standards, generally accepted propriety and public order.
The User agrees to refrain from using any of the Services for unlawful purposes or effects and acknowledges that any such use is prohibited in this Legal Notice. The User likewise agrees that he will refrain from using any of the Services in any manner which may be prejudicial to the rights and interests of third parties or may damage, render useless, overload, deteriorate or prevent normal use of the Services, IT equipment, documents, files or any other contents stored in any IT equipment of CAMERDATA, other Users or any Internet user.
All industrial and intellectual property rights on the website www.camerdata.es.com.org.net and likewise any elements contained therein (including, among others, images, files, graphics, drawings, plans, texts…) belong to CAMERDATA S.A. or, where appropriate, to third party Services.
The User will be held liable for any damages which CAMERDATA may sustain, whether directly or indirectly, as a result of the User's failure to comply with any of the obligations deriving from the Legal Notice or from the law in relation to use of the Portal and the Services. In this regard, the User particularly agrees to refrain from:
(a) reproducing, copying or distributing the contents of the CAMERDATA website ("the Contents"), conveying them to the public at large or otherwise making them publicly available or transforming or amending them, unless authorisation of the owner of the relevant rights has been obtained or such action is permitted by law;
(b) removing, manipulating or otherwise altering the copyright and/or any other information which identifies the reservation of rights of CAMERDATA or of other owners, including digital fingerprints or any other technical means used to enable recognition of such rights.
The User shall refrain from obtaining or even attempting to obtain the Contents by using means or procedures other than those which are provided to him in each case, have been made available to him, are stated on the web pages where the Contents are located, or in general are customarily used on the Internet, provided that such means or procedures do not entail a risk of damage to or failure of the Portal, the Services and/or the Contents
Users and, in general, any persons who intend to create a hyperlink between their website and the Portal (the "Hyperlink") must comply with the following conditions:
(a) no false, inaccurate or incorrect statements shall be made on their website concerning CAMERDATA, its officers, employees, the Portal's web pages or the Services supplied;
(b) it shall not be declared or given to understand that CAMERDATA has authorised the Hyperlink or has supervised or in any way assumed any liability for the services offered or made available on the website containing the Hyperlink;
(c) the website containing a link to the Portal shall contain no unlawful information or contents which are contrary to moral standards, generally accepted propriety, public order or any third party rights.
The creation of a Hyperlink does not, under any circumstances, imply the existence of a relationship between CAMERDATA and the owner of the website containing the Hyperlink, or that CAMERDATA accepts and approves the contents or services of that website.
All trademarks, business names or distinctive signs of any nature which appear in the Portal are the property of CAMERDATA or third parties, and it shall not be understood that the use of or access to the Portal and/or the Services confers upon the User any rights on such trademarks, business names and/or distinctive signs.
The Contents are likewise the intellectual property of CAMERDATA or of third parties. Under the provisions of this Legal Notice, it shall not be understood that any rights of exploitation which exist, whether now or in the future, have been granted to the User beyond those which are strictly necessary for the proper use of the Portal and the Services.
Use of some of the Services requires Users to provide CAMERDATA in advance with certain data of a personal nature (the "Personal Data"). Users authorise CAMERDATA to use the data containing their postal and email addresses so that important business and advertising information may be made available to them in the most practical manner possible. If a User wishes to CANCEL his authorisation to use this data, he must send a message to informacion@camerdata.es, stating in the reference that he wishes to cancel the use of his postal and/or email address, and showing the email address to which the cancellation refers. If a User does not take such action, his postal and email address will remain in our database and it shall be understood that he accepts these terms and conditions. The User may exercise at all times his right to access, correct or remove his personal data by sending a request to informacion@camerdata.es.
Users warrant that the Personal Data they have provided are truthful, accurate, valid and authentic, and agree to keep them duly updated.
CAMERDATA has adopted the security standards required by law to protect the Personal Data and endeavours to install other means and technical measures to provide additional protection. However, the User must be aware that Internet security measures are not impregnable.
In any event, Users agree to accept the terms provided in regard to protection of Personal Data and the general terms and conditions of contract in force at the time they contract a Service.
CAMERDATA works with user session cookies, so that when the browser is closed, the cookie is deleted. Thanks to the cookies, CAMERDATA is able to improve access and browsing for the User, so that in a single session, the User need only identify himself once in order to access all the Services supplied by CAMERDATA or those supplied by third parties. In the Portals supplying CAMERDATA information, the cookies are used to log consumption and the Portal code via which the User has logged in.
The User is aware and voluntarily accepts that his use of the Portal, Services and Contents is under his sole and exclusive responsibility.
CAMERDATA provides no warranty for the availability and continuity of the working order of the Portal and Services. Whenever reasonably possible, CAMERDATA will warn Users in advance of any interruption in the operation of the Portal and Services. Likewise, CAMERDATA does not guarantee the usefulness of the Portal and Services for conducting any specific activity, neither does it guarantee their infallibility or, in particular although not exclusively, that Users may effectively use the Portal and Services, log into the various web pages which make up the Portal or into any other pages from which the Services are provided.
CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE LACK OF AVAILABILITY OR CONTINUITY OF THE WORKING ORDER OF THE PORTAL AND SERVICES. In particular, CAMERDATA does not guarantee that unauthorised third parties will have no knowledge of the type, conditions, characteristics and circumstances of the use made of the Portal and Services by Users.
TO THE FULLEST EXTENT PERMITTED BY LAW, CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE KNOWLEDGE WHICH ANY UNAUTHORISED THIRD PARTIES MAY HAVE OF THE TYPE, CONDITIONS, CHARACTERISTICS AND CIRCUMSTANCES OF THE USE MADE OF THE PORTAL AND SERVICES BY USERS.
CAMERDATA neither controls nor guarantees the absence of viruses or any other elements in the Contents which may have an adverse effect on your IT system (software and hardware) or on the electronic documents and data files stored in your IT system.
TO THE FULLEST EXTENT PERMITTED BY LAW, CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE PRESENCE OF VIRUSES OR ANY OTHER ELEMENTS IN THE CONTENTS WHICH MAY HAVE AN ADVERSE EFFECT ON THE IT SYSTEMS, ELECTRONIC DOCUMENTS OF DATA FILES OF USERS.
CAMERDATA provides no warranty for the legality, reliability and usefulness of the Contents.
TO THE FULLEST EXTENT PERMITTED BY LAW, CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEIVING, OBTAINING OR LOGGING INTO THE CONTENTS, AND IN PARTICULAR, BUT NOT EXCLUSIVELY, FOR ANY DAMAGES WHICH MAY BE DUE TO:

TO THE FULLEST EXTENT PERMITTED BY LAW, CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE LACK OF TRUTHFULNESS, ACCURACY, EXHAUSTIVENESS AND/OR CURRENT VALIDITY OF THE CONTENTS.

CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL, PARTICULARLY, BUT NOT EXCLUSIVELY, FOR ANY DAMAGES WHICH MAY BE DUE TO:
(A) FAILURE TO COMPLY WITH THE LAW, MORAL STANDARDS, GENERALLY ACCEPTED PROPRIETY OR PUBLIC ORDER AS A RESULT OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL;
(B) INFRINGEMENT OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, BUSINESS SECRETS, CONTRACTUAL COMMITMENTS OF ANY NATURE, THE RIGHT TO HONOUR, TO PERSONAL AND FAMILY PRIVACY AND TO A PERSON'S IMAGE, OR INFRINGEMENT OF PROPERTY RIGHTS AND ANY OTHER RIGHTS BELONGING TO A THIRD PARTY, AS A RESULT OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL;
(C) COMMITING ACTS WHICH CONSTITUTE UNFAIR COMPETITION OR UNLAWFUL ADVERTISING AS A RESULT OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL;
(D) LACK OF TRUTHFULNESS, ACCURACY, EXHAUSTIVENESS, RELEVANCE AND/OR CURRENT VALIDITY OF THE CONTENTS TRANSMITTED, DISSEMINATED, STORED, RECEIVED, OBTAINED, MADE AVAILABLE OR MADE ACCESSIBLE BY MEANS OF SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.;
(E) UNSUITABILITY FOR ANY PARTICULAR PURPOSE, AND FAILURE TO MEET THE EXPECTATIONS GENERATED BY SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL;

(G) ANY FLAWS OR FAULTS IN THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.
The Portal makes available to Users technical devices (e.g. links, banners and buttons), directories and search tools which enable Users to log into websites belonging to and/or managed by third parties ("Linked Sites"). The purpose of installing these links, directories and search tools in the Portal is to make it easier for Users to search for and access information, contents and services available on the Internet.
The results of the search tools are provided directly by third parties and are the consequence of the automatic functioning of technical mechanisms. Therefore, CAMERDATA cannot and does not control these results, particularly when among them appear Internet sites with contents which may be unlawful, contrary to moral standards or to propriety or considered, for other reasons, inappropriate. Should the User consider that any of the sites included in the search results contains activity or information which is unlawful and wishes to request that the link be eliminated, he may activate the procedure provided in clause eight of this Legal Notice.
CAMERDATA PROVIDES NO WARRANTY OR ASSUMES ANY LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE WORKING ORDER, AVAILABILITY, ACCESSIBILITY OR CONTINUITY OF LINKED SITES.
The use of CAMERDATA resources and data for the practice known as "SPAM" or "JUNK MAIL" is prohibited. Therefore, CAMERDATA ASSUMES NO LIABILITY FOR ANY DAMAGES WHICH MAY BE DUE TO THE USE WHICH ANY PERSON MAKES OF SPAM OR TO THE PRACTICE OF INDISCRIMINATELY SENDING UNSOLICITED EMAILS.
Should any User or third party consider that there are facts or circumstances which reveal the unlawful use of any of the Contents and/or the unlawful pursuit of any activity in the web pages included in or accessible through the Portal, in particular the infringement of intellectual or industrial property rights (patents, industrial models and drawings, trademarks and business names, etc.) or any other rights, they should bring this to the attention of CAMERDATA, stating the following particulars:
(a) personal details of the complainant: name, address, telephone number and email address;
(b) specification of the alleged unlawful activity conducted in the Portal, and in particular, when the matter concerns an alleged infringement of rights, a precise indication of the contents protected, together with their location on the web pages;
(c) facts or circumstances which reveal the unlawful nature of the activity;
(d) in the event of infringement of rights, a handwritten signature or equivalent, with the personal details of the owner of the rights allegedly infringed or the person authorised to act on that owner's behalf;
(e) an explicit, clear statement, made under the responsibility of the complainant, that the information provided in the notification is accurate, and giving the reason or reasons why the complainant considers that the contents or activities described therein are considered to be unlawful;
All notices and communications (the "Notices") addressed by Users to CAMERDATA will be considered for all purposes as duly delivered when sent to the Department of User Services in either of the following ways:

All notices addressed by CAMERDATA to Users will be considered for all purposes as duly delivered when sent in any of the following ways:
(a) by ordinary mail to an address previously provided by the User to CAMERDATA;
(b) by email to any of the email boxes which the User has or may have as part of any other service provided to the User by CAMERDATA;
(c) by means of a telephone call to a telephone number previously provided by the User to CAMERDATA;
(d) by means of messages on the website which are sent during the provision of any Services by CAMERDATA to the User.
In this regard, all Notices addressed by CAMERDATA to the User are considered validly delivered if they have been sent using the details and by the means described above. For this purpose, the User states that all the particulars provided by him are true and correct and that he will inform CAMERDATA of any changes concerning notification details.
CAMERDATA reserves the right to refuse or suspend, at any time and without the need for any advance notice, the provision of Services to any Users who do not abide by the provisions of this Legal Notice.
In principle, the provision of the Portal and its Services is for an indefinite term. However, CAMERDATA is authorised to suspend or terminate provision of the Portal's facilities and its Services at any time, in which case, whenever reasonably possible, it will give advance notice of such suspension or termination.
